• ELIGIBILITY:

  The Promotion is open only to individuals, 18 years or older at time of entry, who are legal residents of the United States. Employees of Bonnier Corporation and Kawasaki Motors Corp., U.S.A. and their parent companies, subsidiaries, dealers or agents, their immediate families (defined as parents, children, siblings, spouse and grandparents), and those domiciled with any of the foregoing are not eligible.



• TO ENTER:

  Visit our website at http://www.fsolextras.com/kawpower. After you have submitted your registration, you will automatically advance to the game page to receive one (1) Game Play. Each time you return to play, you will be required to log-in utilizing your "e-mail address" and your game "password".
  
  How to Play/Win Instantly: Each time you enter the game page, you will be offered the opportunity to play the Trim & Win Game. Select a displayed Kawasaki Power Product to play. Utilizing your computer mouse curser, left click and begin moving the curser over the area of play. The curser movement will begin to remove the covered area of play to see if you revealed an Instant Win Prize. Instant winning game plays will receive a winning message after the game play has been completed. Non-winning game plays will receive the message "Sorry! Come back tomorrow and try again!". Limit: One (1) Game Play per person or email address per calendar day (as determined by the Website's clock Eastern Time) during the Promotion Period and one prize per person or household address over the Promotion Period. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.



• WINNER SELECTION:

  Eighty five (85) random, computer-generated winning times will be generated across the Promotion Period. If you are the first player during one of these randomly generated time periods, (in case of a tie, the Judge's computer server log will determine "first click" time to confirm the winner) you will be a potential instant winner of the prize indicated. Odds of winning any instant win prize are based on the number of eligible game plays during the Promotion Period divided by the total number of prizes. Any prize that remains unclaimed will not be awarded in any Second Chance Drawing.



• ONLY THE NUMBER OF PRIZES LISTED PREVIOUSLY WILL BE AWARDED IN THIS PROMOTION.

  
  

• PRIZE AWARDS:

  Potential winners will be immediately sent to a prize fulfillment page on the website to complete a form necessary to receive their prize. Prizes are not transferable by winner. No substitution of prize or cash equivalent is permitted except by Sponsors. Winner will look to the manufacturer of each prize element for all warranties and guarantees (if any), and not to the Sponsors. Potential winners may be required to sign and return a sworn Affidavit of Eligibility and Liability and Publicity Release. If required documentation is not returned within ten (10) business days of notification, or if notification is returned as undeliverable, any prize will be forfeited and an alternate winner will be selected by random drawing. All taxes and any other incidental expenses on Prizes are the sole responsibility of each winner.


• ALL POTENTIAL INSTANT WINNING PLAYS ARE SUBJECT TO VERIFICATION BY THE JUDGES, WHOSE DECISIONS ARE FINAL AND LEGALLY BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE INSTANT WIN GAME PORTION OF THE PROMOTION SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR COPIES OF SCREEN CONTENT OR ANY OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED.

  Entry and acceptance of prize constitute permission to use each winner's name, prize won, hometown and likeness for print publication, online posting, and any other promotional purposes without further compensation, except where prohibited by law. By participating in the Promotion, you agree to release Sponsor and its parent company, affiliates, subsidiaries, employees, directors, officers, and agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use, or misuse of any prize. Sponsor is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Promotion, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the prizes, in any Promotion-related materials, or that may limit prize fulfillment or a participant's ability to enter the Promotion. Sponsor reserves the right to amend these Official Rules and to permanently disqualify from the Promotion any person it believes has intentionally violated these official rules. As permitted by law and in accordance with the Sponsor�s Privacy Policy, Sponsor may use information provided by entrants to send announcements about the Sponsor�s products and programs via electronic and ordinary mail.



• PRIVACY:

  By entering, you agree that the information you provide may be sent to promotional partners of the Sponsor(s). You may be contacted by the Sponsor(s) and/or promotional partners with future promotional offers. Information provided by you to participate in this Promotion is subject to the privacy policies of the Sponsor(s).



• DISPUTE RESOLUTION:

  Except where prohibited by law, by entering you agree that: (i) all issues and questions concerning the interpretation, validity, and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of New York, without regard to its rules on conflicts of law; (ii) any action at law or in equity arising out of or relating to this Promotion, or awarding of the prizes, shall be filed only in the state or federal courts located in the State of New York, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action; (iii) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; (iv) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Promotion but in no event attorneys' fees; and (iv) you hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
